Legal notice and general terms

Information about the publisher of this site, the role of Discover Orca in organising trips, and the conditions that apply to bookings.

Important: this document is a starting template. It must be reviewed and validated by a legal professional before any commercial publication, in particular regarding liability, cancellation and the sale of travel services.

The role of Discover Orca

Discover Orca organises group trips and acts as an intermediary. The operation of the outings at sea — boat, crew, safety at sea — is carried out by a partner local Norwegian agency, which is solely responsible for it.

Discover Orca puts the group together, books the accommodation, coordinates the trip and accompanies participants on site. Air travel and transfers to the destination are not included and remain the responsibility of participants.

Booking and deposit

A request sent through the contact form does not constitute a booking. A booking becomes firm once the dates are confirmed in writing by Discover Orca and a deposit has been paid by the participant.

PLACEHOLDER: deposit amount or percentage, payment deadline and balance due date to be specified.

Cancellation and changes

PLACEHOLDER: cancellation scale to be specified (deadlines and amounts retained depending on the cancellation date).

Discover Orca may cancel or modify a trip in the event of force majeure, dangerous weather or sea conditions, or if the minimum number of participants is not reached. In that case, amounts paid are refunded or carried over, excluding costs incurred by participants (flights, transfers, insurance).

An outing at sea cancelled for safety or weather reasons is rescheduled within the trip where possible.

Nature of the activity and liability

Excursions take place at sea, in winter, in Arctic conditions and close to wild animals. No sighting of orcas or northern lights can be guaranteed.

Participants undertake to follow the instructions of the skipper, the guide and the organiser, particularly when entering the water. Failure to follow these instructions may result in exclusion from an outing, without refund.

Participants confirm that they are able to take part in the activities offered: able to swim, able to breathe through a snorkel, and with no medical contraindication to cold-water activity.

Insurance

Each participant is responsible for their own insurance cover. Cancellation, assistance and repatriation insurance covering water activities is strongly recommended. It is not included in the price of the trip.

Intellectual property

All content on this site — text, photographs, videos and graphic elements — is protected. Any reproduction without prior written permission is prohibited.

Applicable law

These terms are governed by Swiss law. PLACEHOLDER: place of jurisdiction to be specified after legal review.
